Chapter 12 - THE ACCOUNT IN CLAIRE’S NAME

Evan created an account in the Cayman Islands six months before the dinner.
He deposited $450,000 using funds diverted from his investors.
Claire was listed as joint owner.
A second transfer of five million dollars was scheduled after the land sale.
Evan told Claire it would be their emergency reserve.
She never disclosed it to Margaret.
Nor to the lenders threatening foreclosure.
The money proved Claire knew the plan was not a temporary family loan.
They intended to sell Margaret’s land, move part of the proceeds offshore and tell her the money had been invested for her care.
Evan planned to place Margaret in a senior residence costing far less than the trust could afford.
The remaining portfolio would be managed by a company he controlled.
Fees would drain it gradually.
Detective Ortiz summarized the strategy:
“First they take authority. Then they take the land. Then they charge you for managing what remains.”
Margaret looked at the statements.
“My daughter signed the account forms.”
“Yes.”
“She used the same middle initial Thomas gave her.”
Ortiz understood the grief beneath the observation.
Even Claire’s betrayal still carried pieces of her father.
Federal investigators froze the offshore account.
The land buyer cooperated after learning the power of attorney was forged.
Its executives claimed Evan represented the sale as fully authorized.
Emails showed the buyer suspected Margaret had not agreed.
One executive asked:
Will the mother create problems?
Evan answered:
After Friday, she won’t be in a position to challenge anything.
The company withdrew from the transaction and paid a civil penalty for failing to verify ownership.
Evan’s business collapsed.
Investors filed claims.
Several construction projects entered receivership.
Claire’s home was foreclosed because Evan had mortgaged it beyond its value.
Margaret could have used her money to save the property.
Claire’s attorney suggested it might demonstrate compassion.
Margaret refused.
“Rescuing her from every consequence helped create the belief that my assets existed to repair her choices.”
She agreed to fund independent legal representation for Claire, as Thomas’s estate documents permitted.
