Chapter 4 - THE TRUST CREATED FOR NOAH
Ryan’s late father, Thomas Bennett, had never trusted Diane with money.
During their marriage, Diane spent aggressively and blamed every shortage on the family businesses.
Thomas quietly created protections.
When he died, most of his wealth entered the Bennett Family Trust.
Diane became temporary trustee.
But only until the birth of Ryan’s first child.
Sixty days after that child’s birth, control would transfer to Ryan and the child’s mother as equal co-trustees.
A full audit would begin automatically.
Noah was fifty-seven days old.
In three days, Elena would gain authority over assets worth more than eighteen million dollars.
Diane would lose the ability to move money alone.
Ryan had explained the trust before Noah was born.
At the time, Elena barely thought about it.
She was preparing a nursery, attending appointments, and worrying about becoming a good mother.
Diane thought about nothing else.
Two weeks after the delivery, she brought Elena a folder.
“It’s a temporary family-care authorization.”
Elena read the first page.
The document would give Diane authority to make medical decisions for Noah whenever Ryan traveled.
“I’m his mother,” Elena said.
“You’re recovering.”
“That doesn’t remove my rights.”
“It makes sense to prepare.”
“I’m not signing.”
Diane smiled.
“We’ll discuss it when you’re less emotional.”
Elena placed the document inside a locked drawer.
The next morning, it was gone.
She told Ryan.
He asked Diane about it.
Diane claimed Elena misplaced it.
Ryan believed the explanation because believing anything else would require him to confront his mother.
Now, while he was in Chicago, Diane took a call from attorney Malcolm Price.
Elena heard only part of it.
“Tomorrow morning,” Diane said. “Yes, the neglect incident will be documented.”
A neglect incident.
Nothing had happened yet.
Diane entered the nursery and saw Elena watching her.
“What?”
“Who were you talking to?”
“The family attorney.”
“About Noah?”
“About protecting him.”
Elena moved between Diane and the crib.
“From whom?”
Diane looked directly at her.
“From the person least capable of admitting she needs help.”
Later, Elena contacted the attorney who had drafted Thomas’s trust.
His assistant refused to discuss the documents over the phone but confirmed one detail.
An emergency guardianship petition had been prepared.
The petitioner was Diane Bennett.
The supporting witness was Chloe.
