Chapter 9 - THE COMPETENCY HEARING
Claire entered the courtroom slowly.
Mara walked beside her.
Her father sat across the aisle in a dark suit. Evan wore a plain shirt and no jewelry. They had dressed to look frightened rather than dangerous.
Their attorney described Claire as a critically ill woman being manipulated by an aggressive trustee.
He argued Mara wanted to preserve control over a valuable trust.
He presented Claire’s missed appointment.
The canceled assessment.
Messages in which Claire said she felt exhausted and afraid.
He did not explain that Claire’s father had canceled the appointment.
He did not mention the forged documents.
When Claire’s cardiologist testified, the attorney asked whether heart disease could affect concentration.
“It can,” the doctor answered.
“Could stress impair judgment?”
“Temporarily.”
Claire’s father lowered his head as though trying not to cry.
Then Mara played the apartment recording.
The father’s voice filled the courtroom.
“Your brother needs it more than your life.”
The judge looked up sharply.
Mara presented the authenticated hospital cancellation call.
Evan’s voice could be heard in the background.
“Dad, hurry up.”
She produced the forged power of attorney and a preliminary statement from the real notary, whose seal had been copied without permission.
Claire’s father whispered to his attorney.
The judge asked Claire to take the stand.
Her hands trembled as she swore to tell the truth.
“Do you understand why surgery is recommended?” Mara asked.
“Yes.”
“Do you understand the risks?”
“Yes.”
“Do you understand the trust?”
“It pays only for my care and protection.”
“Why did you refuse to transfer the money?”
“Because without it, I may not survive the operation or recovery.”
Her father’s attorney stood.
“Isn’t it true that Evan was threatened by dangerous people?”
“Yes.”
“And you refused to help?”
“I offered treatment and police help. I refused to finance more gambling.”
“Your brother could die.”
Claire looked at Evan.
“So could I.”
The attorney suggested Claire’s fear had made her paranoid.
Claire answered calmly.
“Paranoia is fear without evidence. I have a recording, forged documents and a bruise photographed by police.”
The courtroom went silent.
The judge rejected the conservatorship request.
He suspended every authority claimed by Claire’s father and ordered him to remain away from her hospital, doctors and trust.
Then the judge addressed Evan.
“Your sister’s illness is not an opportunity.”
Outside the courtroom, Claire nearly collapsed.
Mara caught her.
An ambulance transported her to the hospital.
Her surgeon examined her and changed the schedule.
The operation could no longer wait until Monday.
Claire needed surgery the following morning.
But someone had already placed a cancellation request in the hospital system.
