Chapter 12 - THE SCARS ON THE WITNESS STAND
Elena testified on the third day of trial.
She wore her hair away from the scarred side of her face.
Not as a symbol.
Because she was tired of planning her appearance around other people’s comfort.
The prosecutor began with the inspection.
Elena explained each defect.
The failed sprinklers.
The chained exits.
The damaged stairwell doors.
Her original recommendation to close the affected floors.
Then the jury saw the altered report bearing her copied signature.
Vivian’s attorney suggested Elena had forgotten signing because of medication after the fire.
“The report was submitted before I was injured,” Elena answered.
He changed direction.
“You were an intern.”
“I was qualified to identify those failures.”
“You entered the fire despite evacuation orders.”
“Yes.”
“Would you describe that as rational?”
Elena looked toward the victims’ families.
“No. I would describe it as a choice made when people were still inside.”
The attorney displayed photographs of her injuries.
Daniel’s hands tightened in the gallery.
Elena remained steady.
“Did Cross Holdings later pay for your treatment?”
“Yes.”
“Did you marry its owner?”
“Yes.”
“Have you benefited financially from that relationship?”
“I signed a prenuptial agreement protecting both of us.”
The attorney had not expected that answer.
Elena continued.
“My husband’s wealth does not change who falsified the inspection.”
Samuel authenticated the prenuptial agreement and Daniel’s recusal from her settlement case.
The defense could not convert the marriage into evidence of conspiracy.
Then prosecutors played Vivian’s recorded instruction:
Use the intern’s signature.
Vivian closed her eyes.
Clara testified under a cooperation agreement.
She admitted deleting emails and helping copy Elena’s handwriting.
She claimed Vivian controlled her.
The prosecutor asked whether Vivian forced her to mock Elena’s scars at the wedding.
Clara began crying.
“No.”
“Why did you do it?”
“Because everyone in my family acted like Elena’s pain was something embarrassing.”
“And you wanted to remain on the powerful side of that family?”
“Yes.”
The answer did not excuse her.
