Chapter 10 - ETHAN’S PROTECTION CLAUSE
Rebecca had never seen the sealed trust addendum.
Ethan stored it with an independent trust protector named Arthur Wells.
Arthur was a retired judge and Ethan’s oldest friend.
The addendum could be opened only under one of three conditions:
Ava turned eighteen.
The acting trustee attempted to extend control.
Or evidence showed that someone was using medical or psychological coercion to interfere with Ava’s rights.
All three conditions were now close to being satisfied.
Arthur came to the hospital carrying a sealed blue folder.
Ava recognized her father’s handwriting across the front.
For Ava, if someone mistakes protection for ownership.
Her hands began shaking.
Arthur opened the document.
The clause stated that if the acting trustee or any company executive attempted to have Ava declared incompetent for financial gain, temporary voting control would transfer immediately to an independent fiduciary chosen by Ava.
The current trustee would lose authority pending investigation.
Raymond’s guardianship petition had triggered the clause.
Marissa no longer controlled Ava’s shares.
Raymond no longer controlled Marissa’s proxy.
Even before Ava turned eighteen, the company’s majority vote was protected.
Ava began crying.
“My dad knew this could happen?”
“He knew power changes people,” Arthur said. “He did not know Raymond. He simply refused to leave your future dependent on anyone’s goodwill.”
There was also a recorded message.
Ethan appeared on a hospital-room screen.
He looked thinner than Ava remembered.
But his smile was the same.
“Ava, I hope you are watching this only because you turned eighteen and Arthur enjoys dramatic paperwork.”
She laughed through tears.
“If you are seeing it earlier, someone may be trying to convince you that your age, fear, illness, or grief makes your voice less valuable.”
Ava covered her mouth.
Ethan continued.
“Listen to qualified people. Ask for help. Change your mind when evidence changes. But never surrender your judgment merely because someone speaks louder.”
Raymond had spent years calling Ava childish.
Her father had prepared for the possibility that an adult might use that word as a weapon.
The message ended with instructions.
Do not become chief executive simply because she owned the shares.
Protect employees.
Demand independent audits.
Separate family love from company authority.
And remember that Bennett Home Systems existed to make people safer.
The court hearing began by video the next morning.
Raymond’s attorney argued that the emergency-room incident proved Ava was emotionally overwhelmed.
Arthur filed the protection clause.
The judge suspended the guardianship petition immediately.
Marissa’s trustee authority was removed.
Rebecca became Ava’s temporary fiduciary at Ava’s request.
Raymond’s attorney objected.
The judge looked at the recordings.
“Your client’s alleged abuse triggered the very protection he was attempting to avoid.”
The petition collapsed.
But the judge still needed to decide whether Marissa had knowingly participated in the fraud and medication scheme.
Her testimony could either protect Ava’s case or damage it again.
