Chapter 11 - The Mother Who Signed in Fear
The courtroom was small.
Brooke sat beside Thomas.
Chloe and Derek sat across the aisle with separate attorneys.
Helen entered last.
She used the cane Brooke had purchased the previous winter.
When the judge asked whether she understood the hearing, Helen said yes.
Thomas presented the residence trust.
The recorded deed.
The mortgage records.
The forged loan documents.
Derek’s attorney argued that Helen had authorized him to manage household finances.
Thomas asked Helen directly.
“Did you give Derek permission to use the house as collateral?”
Helen looked toward Derek.
He gave a small, almost invisible shake of his head.
The judge noticed.
“So did Brooke.”
“Mrs. Bennett?” the judge repeated.
Helen’s hands tightened around her cane.
“No.”
The single word changed the room.
Derek leaned toward his attorney.
Thomas continued.
“Did you sign this property-management authorization?”
“I signed a paper.”
“Did you know it allowed Mr. Hale to borrow against the house?”
“No.”
“What did he tell you it was?”
“A form to reduce the mortgage interest.”
“Did he threaten you?”
Helen began crying.
Chloe whispered, “Mom, don’t.”
The judge ordered her to remain silent.
Helen described the pressure.
Derek said Brooke intended to remove her from the house.
He said Chloe would be arrested for old financial problems if Helen refused to cooperate.
He told her that signing was the only way to keep both daughters safe.
“Why didn’t you tell Brooke?” Thomas asked.
“Because Derek said she would use it to take the house.”
Brooke stared at her mother.
For four years, Brooke had paid to preserve Helen’s home.
Derek had convinced her that Brooke was the threat.
The judge suspended Derek’s access to the property.
He ordered a forensic review of every transaction.
Helen was allowed to remain, but an independent financial guardian would oversee the house expenses.
Derek and Chloe were ordered to vacate within seventy-two hours.
Chloe stood.
“You can’t throw me out of my mother’s home!”
The judge looked at her.
“You changed the locks on the successor trustee. You participated in excluding the person legally responsible for protecting this property.”
Chloe’s face went white.
Derek whispered something to her.
She immediately stopped arguing.
Outside the courtroom, Thomas received the first forensic report.
More than mortgage payments had been diverted.
Derek had transferred money from Helen’s retirement account.
Some transactions required a second electronic approval.
